Terms and Conditions for PureClaim, Inc.

These Terms and Conditions ("Terms") govern your access to and use of the PureClaim, Inc. mobile application, website, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. About PureClaim, Inc.

1.1 Company Overview

PureClaim, Inc. provides tools and services that help users review, analyze, and negotiate their medical bills. Our Services combine human expertise and advanced technology—including artificial intelligence—to identify billing errors, dispute overcharges, and negotiate cost reductions with healthcare providers. Our goal is to make medical billing transparent, accurate, and fair for everyone.

1.2 HIPAA Compliance and Data Protection

PureClaim complies with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and related regulations. As a Business Associate to certain covered entities, we maintain strict safeguards for Protected Health Information ("PHI") and follow policies for secure collection, storage, transmission, and breach notification. Any access to PHI by PureClaim staff or systems is authorized, audited, and monitored for compliance.

2. Acceptance and Modification of Terms

2.1 Acceptance

By using the Services, you confirm that you are at least 18 years old, have read these Terms, and agree to our Privacy Policy. If you use the mobile App, these Terms also apply to your use through Apple's App Store or Google Play Store, including their respective terms of service.

2.2 Modifications

PureClaim may update or modify these Terms at any time. Any changes will be effective upon posting within the App or on our website. Continued use after updates constitutes your acceptance of the revised Terms.

3. Description of Services

3.1 Scope of Services

PureClaim provides medical bill review, error detection, and negotiation services. These may include:

  • Identifying and correcting billing errors and duplicate charges
  • Disputing overcharges or non-covered services
  • Negotiating cost reductions or refunds with providers

3.2 Technology and Artificial Intelligence

Our Services use a combination of human specialists and AI systems. AI helps analyze billing data and flag possible discrepancies; final review and negotiations are performed by trained professionals.

3.3 Service Availability

PureClaim strives for continuous availability but cannot guarantee uninterrupted or error-free operation. Maintenance, updates, or network outages may occasionally affect access.

3.4 Mobile Application Features

The PureClaim App may request permissions to access your device's camera, photos, documents, or storage solely so you can upload medical bills or insurance cards. Push notifications may be used for updates or reminders. You may manage these permissions in your device settings at any time.

4. Data Ownership, Privacy, and Security

4.1 Data Ownership

You retain ownership of all data and content you provide. By submitting data, you grant PureClaim a limited, non-exclusive, worldwide, royalty-free license to use, process, and store your information solely to deliver and improve our Services.

4.2 Privacy and Use of Personal Information

Your information is collected and used according to our Privacy Policy and applicable laws, including HIPAA. You are responsible for ensuring that information you upload or share is accurate and lawfully obtained.

4.3 Security Measures

We protect your data through encryption, access controls, continuous monitoring, and HIPAA-compliant safeguards. In case of a security incident involving PHI, we will notify affected users as required by law.

5. Registration and Account Security

5.1 Account Registration

To access certain Services, you must create an account and provide accurate information. You agree to keep this information current.

5.2 Account Security

You are responsible for keeping your login credentials secure and for all activity on your account. Notify us immediately at support@pureclaim.com if you suspect unauthorized access. We are not liable for losses resulting from compromised credentials.

6. Payment and Billing

6.1 Payment Terms

Some features may require payment. By purchasing a service or subscription, you agree to pay all applicable charges as displayed at checkout. Fees are non-refundable unless required by law.

6.2 Billing Information

You must provide accurate billing details. PureClaim reserves the right to suspend or cancel access if payment issues occur.

6.3 Payment Authorization and Recurring Charges

By using paid Services, you authorize PureClaim to process one-time or recurring payments through our secure payment processor, Stripe, Inc.

  • Consent: Each "Pay" or "Confirm" action constitutes consent for the specified charge.
  • Timing: Lump-sum payments process immediately. Installment and subscription charges process on their respective schedules until canceled.
  • Cancellation: You can cancel recurring payments anytime through the App or by contacting support@pureclaim.com at least three business days before your next charge.
  • Data Sharing: Limited card and transaction data are shared with Stripe solely for payment processing and fraud prevention. Stripe's use of your data is governed by its own privacy policy.

6.4 In-App Purchases

If you make payments through Apple or Google's in-app purchase systems, those transactions are subject to their respective terms and refund policies. PureClaim does not control or store your payment information for such purchases.

7. Prohibited Conduct

You agree not to misuse the Services. Prohibited behavior includes:

  • Submitting false or misleading information
  • Uploading unauthorized or unlawful content
  • Attempting to access or modify our systems without permission
  • Reverse-engineering or copying software code
  • Transmitting malware or interfering with security features

Violations may result in suspension or termination of your account and potential legal action.

8. Intellectual Property

8.1 Ownership

All intellectual property related to the Services—including the App, software, algorithms, graphics, and trademarks—belongs to PureClaim, Inc. You may not reproduce, distribute, or create derivative works without our written consent.

8.2 User Content

You retain ownership of content and data you provide. You grant PureClaim a limited license to use and process your content to operate, improve, and deliver our Services.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

The Services are provided "as is" and "as available." PureClaim makes no express or implied warranties, including merchantability or fitness for a particular purpose. We do not guarantee that all billing errors can be resolved or that every negotiation will result in savings.

9.2 Limitation of Liability

To the fullest extent permitted by law, PureClaim, Inc. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Services. Our total liability for any claim shall not exceed the amount you paid to PureClaim in the three (3) months preceding the event giving rise to the claim.

10. Termination

10.1 By You

You may terminate your account at any time through the App or by contacting support.

10.2 By PureClaim

We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or use the Services unlawfully.

10.3 Effect of Termination

Upon termination, your right to use the Services ends immediately. We may retain certain data as required by law or for legitimate business purposes consistent with our Privacy Policy.

11. Dispute Resolution and Governing Law

11.1 Dispute Resolution

Any dispute arising under these Terms will be resolved through binding arbitration rather than in court. You waive any right to a jury trial or to participate in a class action. Arbitration will take place in the state where PureClaim is headquartered.

11.2 Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws principles.

12. Mobile Application Terms

12.1 App Permissions

When you use the App, you may grant permissions such as camera, photos, storage, or location. These permissions are optional and can be changed in your device settings.

12.2 Push Notifications

We may send service-related notifications (for example, bill updates or savings results). You can disable notifications through your device settings.

12.3 App Store Compliance

Your download and use of the App are also subject to Apple's App Store Terms of Service and Google Play Terms of Service. PureClaim, not Apple or Google, is responsible for support and compliance.

12.4 App Updates

We may automatically update the App to improve performance or security. Continued use after an update indicates your acceptance of the new version.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, form the complete agreement between you and PureClaim, Inc.

13.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

13.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver.

13.4 Assignment

PureClaim may assign its rights or obligations at any time. You may not assign these Terms without our prior written consent.
